1) Acceptance of Terms

By clicking “I accept,” creating an account, or using the site, you agree to these Terms & Conditions (the “Terms”). If you do not agree, do not use the site or services.

2) Who We Are & What We Offer

CareNexa, LLC, dba Molecular Testing Labs (“CareNexa,” “we,” “us”), provides at-home DNA wellness tests:

• Methylation Genetic Test (saliva)

• Fitness + Nutrition DNA Test (cheek swab)
  Our services are informational and educational. We do not provide medical care, diagnosis, or treatment. In an emergency, call 911.

3) Not Medical Advice

Content and results are for wellness only and are not a substitute for professional medical advice. Always seek the advice of a qualified clinician for questions about your health. You are responsible for how you use any information from CareNexa.

4) Eligibility & Location

You must be 18+ (or the age of majority in your state). For minors, a parent/guardian must consent and manage the account. Services are offered in the United States; access from elsewhere is at your own risk and subject to local law.

5) Accounts & Security

Provide accurate information and keep your password secure. You are responsible for all activity in your account. We may suspend or terminate accounts that violate these Terms.

6) Ordering, Activation, and Sample Collection

You may purchase a kit and must activate it in your account. Follow collection instructions (saliva or cheek swab) and return the sample using the prepaid mailer to our CLIA-certified, CAP-accredited laboratory partner. If a sample is unsuitable (e.g., leakage, contamination, insufficient DNA), we may withhold results; we typically offer a replacement kit.

7) Results & Turnaround

Timing varies with shipping and lab volume. Results appear in your secure account with plain-language explanations and “Personalized Guidance.” Results reflect inherited DNA and may include limitations; rare technical errors can occur.

8) Purchases, Pricing, Shipping, Refunds

• Payment: Due at checkout via accepted methods shown at purchase. Taxes and shipping may apply.

• Pricing: Subject to change; promotions may vary.

• Shipping: U.S. only; dates are estimates. Risk of loss passes on carrier hand-off.

• Refunds: If you cancel before activation/testing, a refund may be available per posted policy. Once testing starts, refunds are generally not available. If lab failure occurs not due to user error, we provide a replacement kit.

9) Privacy, HIPAA & Data Use

We protect Protected Health Information (PHI) under HIPAA and use administrative, technical, and physical safeguards (including encryption and access controls). See our Privacy Policy and HIPAA Notice of Privacy Practices for how we collect, use, share, retain, and de-identify information; your rights to access, correction, restrictions, confidential communications, and account deletion; and breach notifications. We may create and use de-identified and aggregated data from your PHI for quality, analytics, research, product improvement, and any other commercial purpose. Optional research or additional sharing uses your explicit authorization.

10) User Conduct

Do not misuse the site (e.g., unlawful activity, reverse engineering, interfering with security, uploading harmful code, scraping, or infringing others’ rights). We may remove content or suspend accounts for violations.

11) Intellectual Property

The site, content, software, and trademarks are owned by CareNexa or its licensors and are protected by law. You receive a limited, personal, non-transferable license to access the site for lawful personal use. No other rights are granted.

12) User Content & Feedback

If you submit content (questions, reviews), you represent you have rights to it and grant CareNexa a non-exclusive, worldwide, royalty-free license to use it to operate and improve the services and for marketing in any media. Do not submit unlawful, infringing, or harmful content. Ideas or suggestions you send may be used without obligation to you.

13) Electronic Communications & Notices

You agree to receive electronic communications about your account, orders, and policies. You may manage certain preferences in your account. Legal notices may be sent to the email and address on file.

14) Changes to the Services or Terms

We may update the site or these Terms at any time. Changes are effective when posted. Your continued use means you accept the updated Terms. If you disagree, stop using the site.

15) Disclaimers (No Warranties)

The site, kits, and services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties (express, implied, statutory), including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not guarantee error-free results or that the site is free of harmful components.

16) Limitation of Liability

To the maximum extent permitted by law, CareNexa and its affiliates, labs, suppliers, and partners are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages; loss of profits, data, goodwill, or business; or costs of substitute services, arising from or related to your use of the site or services. Our total liability for any claim will not exceed the amount you paid for the kit or service giving rise to the claim.

17) Indemnification

You agree to indemnify and hold CareNexa and our affiliates, officers, employees, and partners harmless from claims, damages, losses, and fees (including reasonable attorneys’ fees) arising from your misuse of the site, violation of these Terms, or infringement of third-party rights.

18) Dispute Resolution; Arbitration; Class Action Waiver

Before filing a claim, both parties will try in good faith to resolve disputes informally within 30 days. If unresolved, binding arbitration administered by the American Arbitration Association (AAA) will apply, with one arbitrator, and may be conducted by video, phone, or on written submissions. Venue: Seattle, WA. Governing law: the State of WA(without regard to conflicts rules). Class and representative actions are waived—disputes are handled only on an individual basis. Either party may seek temporary injunctive relief .

19) Termination

We may suspend or terminate access at any time for any reason. You may stop using the site at any time. Sections that by nature should survive (e.g., IP, privacy, disclaimers, liability limits, dispute resolution) will survive termination.

21) Miscellaneous

• Entire Agreement: These Terms plus referenced policies are the entire agreement.

• Severability: If a term is unenforceable, the rest remains in effect.

• Assignment: We may assign these Terms; you may not without our consent.

• No waiver: A failure to enforce is not a waiver.

• Headings: For convenience only.
